Abstract (EN)
The Ottoman Empire lived as an important power in world politics for many years and had an important influence on the states in relation to it. However, in parallel with the loss of financial and military power of the state over time, social deterioration began and the judicial system got its share. Prior to period, the administrative ,judicial,criminal,civil and commercial cases in the judicial system of the Ottoman Empire brought about negative problems such as the corruption of madrasas where the judges(kadi) were raised and the judges(kadi) were unqualified. The legal system was one of the are as in which the Ottoman Empire applied the legalization movements because the law was a set of rules governing the relations of the people living in the society with each other and with the state. This study examined the sources on which Ottoman state law was based, and addressed the structure of the judicial organization before and after the proir to Tanzimat period. The reforms brought by the new laws in comparison to the old laws, the laws made in the field of punishment and law, the establishment of the viii Ottoman judicial organization since 1879, the judges(kadi) beside, has been noted.The process from the establishment of the institution to the fall of the Ottoman Empire has been discussed. In order to find answers to the questions such as how the duties ot the judges(kadi) ,such as conducting inverstigations and inverstigations, were replaced over time by the institution of the periodical community was useful to the Ottoman place proces to the judicial system, the Erzurum province, which is a central province, was detailed by the model.
