Transfer of commercial enterprise

The Turkish Commercial Code No. 6102 introduce many innovations with itself. Transfer of commercial enterprise as a whole is without doubt one of the most important innovations. Transfer of commercial enterprise as a whole, results in continuation of the enterprise, which is the main concept of commercial law. In this regard, it is highly important for the business life and national economy. While analyzing the concept of transfer of the commercial enterprise that constitutes the subject of the thesis, firstly the concepts of enterprise and commercial enterprises and their components and their comparison with other concepts are examined. After that, transfer of commercial enterprise and assignment was analyzed. The comparative analysis of the transfer of the commercial enterprise with similar concepts was examined, and finally the terms and conclusions of the transfer of commercial enterprise were discussed. The first reason why the transfer of the commercial enterprise was chosen as the thesis subject is that the concept of commercial enterprise transfer has such a great proposition in the name of both commercial law and commercial life, as explained above. In addition to the new regulations in Turkish Commercial Code numbered 6102, Turkish Law of Obligations numbered 6098, Code of Civil Procedure numbered 6100, Industrial Property Law numbered 6769 entered into force and the fact that many secondary arrangements have been made and the lack of scientific studies about transfer of commercial enterprise constitute the reasons of the thesis on the transfer of commercial enterprise.
