The crime of fuel slaughter in Turkish criminal law

Abstract (EN)
Fuel oil, which can also be obtained from petroleum and non-petroleum substances, is the most important energy source used by countries in a wide area from transportation to industry. While population growth, industrialization and other technological developments increase the need for fuel, this increase in demand has begun to be met with some illegal methods. Since fuel smuggling causes tax loss, it harms the country's economy and also harms the consumer, human health and the environment. In order to prevent fuel smuggling and to fight more effectively, "Penal provisions regarding smuggled oil" were regulated in the Additional Article 5 of the Petroleum Market Law No. 5015 on 13 February 2007. Due to the problems arising in practice, penal provisions regarding smuggled fuel were transferred to the Anti-Smuggling Law No. 5607. In the study, the causes, methods and changes in fuel smuggling were examined. In addition, in the study, both the theoretical principles of fuel smuggling and the emerging problems are examined. In this framework, the elements of fuel smuggling crimes were examined, as well as the sanctions regime and procedural law provisions and the problems in practice.
