Disciplinary law jurisdiction of Turkish Dental Association and Dental Chambers

Right to health is one of the fundamental rights which are protected by universal law, international treaties and constitution. Services directly related to right to health have public service quality. On the grounds of this quality and importance of it, medical service and practice are subjected to a variety of inspection and sanction mechanisms, one of which is that the practices of members of profession whic are against professional standards and ethics could be imposed diciplinary sanctions by competent authorities. In regard to the field of dentistry, Turkish Dental Association and Dental Chambers, the professional organizations with public institution status for members of the profession, are authorized to make disciplinary inspections, take legal proceedings and impose sanctions on the members of profession who are alleged to have acted against moral code of professional ethics. In the first capter of this study, legal status of Turkish Dental Association and Dental Chambers is discussed. In this context, the notion of professional organizations with public institution status, main features of professional organizations with public instititution status, background, bodies and mission of Turkish Dental Association and Dental Chambers and interrelation between Turkish Dental Association and Dental Chambers are discussed. In the second chapter of this study, the legal basis for the disciplinary sanction authorisation of Turkish Dental Association and Dental Chambers and the dominating principles of the disciplinary ordonnance system of Turkish Dental Association and Dental Chambers are discussed. In the third and the last chapter of the study, disciplinary investigation and legal proceedings procedure, nature of sanctions, supervision of sanction decisions and conditions of erasure of entry in register by Turkish Dental Association and Dental Chambers are discussed.
