Özet (EN)

Although the marital obligations expire upon the termination of a conjugal union in consequence of divorce, Turkish Civil Code 4721 sets forth the alimony obligation in order to enable the spouse and children that will be driven to poverty subsequent to divorce to continue their lives in accordance with their social level. As an aspect of the state's function to take required measures and organize the structure for the familial peace and welfare and protection of the mother and children pursuant to Article 41/2 of the Constitution, this obligation is satisfied via temporary alimony for the spouse and children as from the filing date of the divorce case and via welfare alimony for the spouse that will be driven to poverty and via child support for the minor child as from the finalization date of the divorce judgment. The subject of this paper is "The Temporary Alimony, Welfare Alimony, and Child Support in Turkish Law". In this context, we have addressed in the first place the concept of alimony, legal nature of alimony, properties of the alimony claim, and types of alimony; individually studied the temporary alimony, welfare alimony, and child support; and researched the conditions to file an application for each alimony type, determination of the amount, increase and decrease thereof, and commencement and termination of alimony together with the procedural provisions on the competent court in addition to referring to the relevant court orders.
