Abstract (EN)

Our study is with the title of the dismiss penalty in the Turkish Armed Forces (TAF) consists of three main sections. The reason why we choose this topic is to tell the end of dismiss process based on the decision of the Supreme Military Council because of discipline and moral status in legislation and in the light of new Armed Forces Discipline Act to determine the duties, authority, work, the procedures and principles of Turkish Armed Supreme Disciplinary Committee (SDC) that is the single and only authorized organization. In the first chapter of our thesis, it's indicated that what discipline means in terms of TAF, the definition of discipline laid down in many different ways and with different definition of discipline types. It's indicated the source of dismiss penalty in specific and in general military discipline. The different definitions of the discipline penalty and the discipline offence in doctrine are given and finally the basic principles which are related to discipline offence and penalty are tried to explain. In the second part of our thesis, it has discussed the types of military discipline offences and serve part-time attendance, salary cut, no leaving the service location and the room imprisonment had brought up. However, some actions that require disciplinary action were also discussed briefly here. In the final chapter of our thesis, the organizational structure of SDC is discussed. Referring to the indiscipline that requires the dismiss penalty from TAF, a new method of dismiss and penalty points and number of penalty system are discussed detailed. After discussing dismiss procedures from TAF, establishing of SDC, meeting procedures and the decision to be taken by SDC are devoted. The fulfillment of the decision to be taken by SDC and the results are discussed. Keywords : Turkish Armed Forces, dismiss penalty, discipline, Supreme Disciplinary Committee, principles.
