The free movement rights of SMEs in Turkey at the European common market

At internal and external trade SME has a big role, in world and in Turkey. Turkish external trade which is mostly with EU is a common fact. So, at the foreign trade with EU, it's necessary to become definite the legal rights of Turkish SME in terms of partnership law between Turkey and EU.For designation of rights on laws of Turkish SME at law of partnership, firstly it is needed to be understood of free movement common concept in market in EU. Relevant concept is often commented by Court of Justice which is the Court of Union. Consequently free movement concept is needed to examine in according to similar judgment of Court of Justice.In common market of EU, free movement right of Turkish SME is designated by partnership law between EU and Turkey. Determinating the rights spesificly can?t designate extents and limits of that rights. At that extent Court of Justice which is tasked to solve of appeared problems by partnership law is tasked to consider to example decisions of free movement of Turkish citizens and companies. Besides decisions about free movement which is given by Court of Justice in common market in EU can be constituted or not as a example in terms of Turkish SME, that question is discussed too by this prepared thesis.Within partnership law, it's undoubtedly that Turkish SME has some rights. In terms of relevant rights, Court of Justice has some limiting comments about nations which in EU too.By this prepared thesis, problems of free movement of Turkish SME in common market in EU is tried to solve in the way of partnership law.Key Words: SME, European Union, Free Movement, Partnership Law, Court of Justice.
