Abstract (EN)
The International Criminal Court is a permanent judicial body created by the international community and established under the Rome Statute in order to prosecute and investigate the most severe international crimes. States sensitivity to sovereign rights is the main reason why the International Criminal Court was not established until the end of the twentieth century. The International Criminal Court was not established as an organ of the United Nations, he was established as an independent body and its relationship with the United Nations is determined by the agreement. The need to protect the Court from the veto of the United Nations Security Council and the necessity of radical changes in the United Nations Treaty were effective in making this decision. From all of the United Nations bodies, The United Nations Security Council has the largest jurisdiction over the work of the Intenational Criminal Court. As well as the power to bring an event to the International Criminal Court, the United Nations Security Council was also given the right to prevent the Court from looking at a case. Therefore, many believe that the interventions of the United Nations Security Council undermines the independence and impartiality of the International Criminal Court. However, in order to protect international peace and security, these two international institutions have the greatest authority.
