Abstract (EN)
This thesis aims to address Turkey's legal, administrative and practical problems in migration management within the context of international norms under the title of "Constraints on Turkey's Establishment of an Effective Migration Legislation within the Framework of International Migration Policies and Legislation". The main purpose of the thesis is to analyse the historical development of Turkey's migration policies, its compliance with international law and the fundamental problems encountered in migrants' access to their rights and to offer solution suggestions. The method used in the thesis is based on descriptive and normative analysis approaches. A historical background of Turkey's migration policies is presented, then national and international legislation is comprehensively examined. Within the scope of the research, basic legal texts such as the 1951 Geneva Convention and its 1967 Protocol, the Law on Aliens and International Protection (YUKK) and the Temporary Protection Regulation are analysed, while the Turkey-EU Readmission Agreement and the impact of international organizations (UNHCR, IOM) in migration management are evaluated. The study was prepared using qualitative research methods and is based on data obtained from existing academic literature, official reports and publications of international organizations. The findings of the thesis reveal that Turkey is experiencing various problems in its compliance with international migration legislation. In particular, the geographical reservation practice prevents the long-term integration of migrants and creates legal uncertainties. The lack of effective coordination between local and central governments in migration management, the inadequacy of digital infrastructure, the length of administrative processes and the limited capacity of personnel stand out as the main factors restricting migrants' access to rights. In addition, living conditions in repatriation centers and non-compliance with international norms create significant problems in the protection of migrants in the context of human rights
