Abstract (EN)
The regimes based on self-regulation and market regulation prove to remain ineffective in the face of human rights violations perpetrated by transnational corporations who acquired enormous power due to the neo-liberal policies adopted by States and the phenomenon of economic globalization. Furthermore, accountability mechanisms under domestic law systems cannot function effectively against abusive transnational corporations, which results in inadequate redress for the victims and impunity of those responsible. However, since corporations already have human rights obligations, especially with regard to the peremptory norms of international human rights law and humanitarian law, they shall be held responsible before international judicial or quasi-judicial institutions, which will be established and authorized as complementary mechanisms to domestic human rights protection systems.
