Refugee children's right to education in international and national regulations

Throughout history, numerous crises have compelled many individuals to be displaced from their homes. These displaced individuals have migrated to other countries to secure their lives. As a consequence of migration, they have encountered integration challenges and faced marginalization in the countries where they resettled. Unfortunately, the most affected and traumatized group during this process has been children. Irrespective of their status and identity; ensuring the legal protection of children and their possession of universal rights is vital. Determining the status of refugees and subsequently establishing their rights has been a legal process. Throughout this process, refugee definitions have evolved, their rights have been expanded on international platforms, and states have been guided by international standards in shaping their domestic laws. This study is structured into three parts. In the first part, addressing the question of who the subject of the study is, the fundamental concepts of refugee and refugee children have been emphasized. The scope of the refugee child concept, as well as how these concepts are addressed in international regulations and national legislation, has been examined. The second part of the study focuses on the right to education to facilitate the impression provided by the third part. International and national legal texts regulating the right to education have been examined, attempting to explain how the right to education is regulated in these texts, what its basis is, and how it is organized. In the third part, within the framework of the right to education addressed in the second part, the education rights of individuals identified as subjects in the first part have been examined. In this section of the study, the education rights of refugee children have been presented within the framework of international and national regulations corresponding to the first two parts. Subsequently, the steps through which refugee children and children under temporary protection can access the right to education are explained. The section then highlights the challenges faced by these groups in accessing the right to education, offers suggestions on overcoming these challenges, touches upon some concrete incidents in practice, and refers to decisions of the European Court of Human Rights (ECHR). Following the explanation of the importance and principles of inclusive education, the study concludes with the results section. In the conclusion, the findings of the study are identified, and recommendations are provided to address certain deficiencies in practice.
