Effect of change of sub employers on labor receivables and results

As a result of changing economic conditions nowadays, economic problems that companies face bring up the issues of the competition between employers, the change in the organizational behavior in working place and the transfer of the companies as partly or completely. The inevitable situation is in the case of labors becoming weak when there is a transfer of a company. In practise the most common problem that we face and the main idea of this article is to frame the boundaries in terms of the doctrine and legal awards through the concepts of companies that have primary employer and sub-employer relationships, as a result of the termination of the employment contracts that are signed between sub-employers and main employers, the transfer of the employees that belong to sub-employer and working in the main employers company, the legal framework of this transfer action and the effect of it to the legal rights of sub-employer's employees. In fact, both in practise and doctrine, there are different views and opinions about if the transfer should be defined as a contractual transfer (employment contract) or company transfer. As a result of changing sub-employers repeatedly, the supplying of labor assurance of the labors of different sub-employers and protection of them is important and should be determined and analyzed. Both views on this issue carry out different legal qualification and necessities, in which this differences effect labors to a great extent thus this difference will be analyzed through this article.
