Service level agreement within the scope of IT Law

Service level agreement is a bilateral, onerous, sui generis agreement in which actions to be performed are regulated in detail and automatically measured, service level targets are determined and sanctions agreed by the parties in the contract are applied due to the breach of contract. Service level agreement is a contract of continuous performance. In this work, "Service Level Agreement Within the Scope of IT Law" is discussed from different perspectives and examined in three chapters. In chapter one, the definition, elements and parties of the SLA are given a place. Furthermore, the establishment and form of the SLA were examined. Finally, the legal status of the SLA has been analyzed. In chapter two, obligations of the parties and the consequences of the breach of obligations are examined. Within the scope of the obligations of the parties, the obligations of the service provider and the obligations of the client are embraced disjointly. In terms of the consequences of the breach of obligations, the breach of obligations of the service provider and the client has been analyzed severally. The general provisions and the sanctions agreed in the SLA are discussed within the context of service provider's breach of the obligation. Lastly, in the third chapter, the termination of the contract and the consequences of the termination are included. The cases of termination are examined by dividing them into two as spontaneous termination and termination by legal transaction. Within the scope of the consequences of the termination, the general consequences of the termination, the return obligation and the connection between the framework agreement and the SLA are studied.
