Abstract (EN)
Besides the fact that in republicain regimes governed by democracy, it is impossible for anyone to occupy a place beyond the laws in respect of his/her owned position, it is also unacceptable for the ones furnished with authorities such as to cause executive impression, to be irresponsible for his/her exercise of these authorities. As is seen in the sample of 1982 Constitution, within the constitutional order where the liability regime of the president of the republic has not been proposed in extenso and clearly, the subject, constituting an attribution about the criminal liability of the president of republic, is the probability of intertwinement of criminal liability with the political liability. In this case, it is possible for the said constitutional gap and/or obscure conceptions existing in constitutional orders, to complicate the differentiation of the criminal liability from political liability, and for the situation in question, to cause irresponsibility paradox of the president of the republic. Due to the aforementioned reasons, the matter of criminal liability of the president of the republic requires comprehensive examinations depending on the basis of differentiation of the criminal liability from political liability, where there is a constitutional gap regarding the subject.
