Administration's liability arising from service failure

The responsibility of the service resulting from the service defect that is proportional to the width of the field of activity of the administration strongly protects its currentness in the flow of life. States must compensate for this damage quickly and effectively in cases where persons are harmed by their own flaws as a state of law and social state. This thesis, in this regard, by analyzing the current situation in the responsibility of the administration due to the service defect, handles the issue from different perspectives and concludes with a welfare-based understanding based on the general principles of the law. While doing this, especially the concepts that have no clear definition in the legislation have been dealt with in the light of the opinions of different legal writers and a logic has been tried to be established. On the other hand, due to the importance of the case law of the Council of State in the responsibilities arising from service defects, references were made to the case law and quotations of the judiciary were evaluated. As a result; As the services of the administration and the damages arising from these services are a dynamic issue, it is extremely important to capture and criticize the current knowledge and understanding. This thesis is written with this logic and aims to make the subject more understandable.
