Consensus in Islamic legal procedure (İjma' understandings of Ghazali and Ibn Rushd)

The subject of ijma' has been discussed for long periods in the Islamic legal literature. Many issues such as the actuality, functionality, changeability of ijma, the changeability of ijma after ijma' on an issue, whether ijma is possible in today's conditions have occupied the agenda of Islamic scholars. This study aims to address the problems related to ijma, which is one of the main sources of Islamic law and maintains its importance in every period, to find solutions to these problems and to be able to produce solutions to these problems, and to be one of the leading mujtahids of the Shafi'i sect (d. 505/1111). and Ibn Rushd (d. 595/1198), one of the leading mujtahids of the Maliki sect, on the subject of ijma' and these disagreements were answered. The study prepared in this context consists of three parts. In the first part; Information about the lives, educations, scientific personalities and works of Ghazali and Ibn Rushd is given. In addition, the works written by both mujtahids on the fiqh method were introduced in detail. In the second part, the main subject of our study, ijma', the meaning and source of ijma, the process of emergence as evidence, the possibility of formation, the elements and parts of ijma, the conflicts related to ijma and the answers given to these disagreements are discussed in general terms. In the last part, the views of Ghazali and Ibn Rushd on ijma are discussed in a comparative way. Key words: Islamic Law, Ghazali, Ibn Rushd, Shari'a proofs, Ijma
