Abstract (EN)

Sheikh Badreddin wrote a book titled Jâmi' al-Fusûlayn which had been used for a long time in the Ottoman Empire as a handbook for judges. In this book, he combined Majd al-Dîn al-Usrusheni's (632/1235) al-Fusûl and Zayn al-Dîn al-Margīnânî's (670/1271) Fusûl al-Ihkâm fi Usûl al-Ahkâm. Sheikh Badreddin objected to some issues involved in the leading texts of Hanafi school in the study. In subsequent periods, some scholars wrote books in order to response to his objections and criticisms. One of these books is Nûr al-Ayn fî Islâh Jâmi' al-Fusûlayn by Nisancizade Mehmet. Our study consists of three chapters; the first chapter ise devoted to how Hanafî scholars dealt with the issue of alfâz al-kufr until Nûr al-Ayn fî Islâh Jâmi' al-Fusûlayn and analysis of the works written about this issue in the Ottoman Empire. The second chapter is dedicated to examination of the 40th part of Nûr al-Ayn fî Islâh Jâmi' al-Fusûlayn and 38th part of Jâmi' al-Fusûlayn and its 40th part are compared. In the last chapter, the 40th part of Nûr al-Ayn fî Islâh Jâmi' al-Fusûlayn is critically edited based on two copies by Nisancizade Mehmet.
