Woman in the Social Insurance Law: An evaluation according to acts numbered 506 and 5510

Abstract (EN)
Social security, which is an extension of the Social State principle and which is defined as the right of every individual member of the society to demand from the society against the risks he/she is faced with, is safeguarded by the State according to the Constitution. The State is obliged with establishing organizations and taking necessary measures in order to provide for the social security. Social security for employees and their households is provided by the social security system which has been organized by the state. Social insurance as a legal structure is interested in the family and individuals in family according to their legal status, as well as their relationship with the social insurance system. When the family is considered as the basis, relationship of the individual with social security law is either direct or endirect.It is not possible to examine the situation of the women, who are the subject matter of this study, as an individual within scope of Social Security Law. Women are in a direct or indirect relationship with the social security system according to their legal status within the family. While a woman as an individual is in a direct (original) relationship with the system for her dependent work, she is in an indirect (attached) relationship with the social security system by means of her role as a wife, daughter and mother of the insured family member. The originally insured person for the woman is her husband when she is a wife; her parents when she is a daughter; her son/daughter when she is a mother. The important point here is to protect women from all the social risks that they can be faced with.There have been fundamental changes in Turkish Social Insurance Law and Turkish Social Security System since the beginning of this study. The act numbered 506, which was about the dependently working women, was abolished and replaced by the act numbered 5510 Social Insurance and General Health Insurance Act. In this study, women?s status in the Social Insurance Law as the original or attached insured, are examined according to both acts and their rights and obligations are evaluated.
