Abstract (EN)

It's seen that the Old Civil Code gives the parties the opportunity to deal with the side effects of the divorce under the provisions of Article 150 / V, before the legal divorce takes place in the Turkish Law after the ammendments made by the Law No. 3444. This change has been preserved and it has been possible for the parties to agree on a divorce decision with a new substance (TMK m.166 / III), financial results and children's custody. Thus, if the parties decide to divorce, they can apply together, or if one's application is accepted by another, a case can be settled with a signed divorce title. An agreed divorce case can be sued if the spouses are married for at least one year. If the parties can agree on the consequences of divorce, such as custody, maintenance, compensation, the judge can rule divorce. What is important at this point is that the parties must declare their free will and the agreement must be provided with free will. Even if the parties agree on matters such as the poverty of alienation and participation, the agreement on these matters is not provided and the judge should discretion in case the judge does not approve it. However, the liquidation of the property regime resulting from the divorce can also take place in the direction of the asset regimes of which the parties are natural, and the otherwise mutually agreed issues concerning the matters specified by the law do not apply. Key words: Divorce, Consensual Divorce, Parties in the Consensual Divorce, Children in the Consensual Divorce.
