Abstract (EN)

The adoption institution which entered into the Turkish legal system with the old Law No. 743 was a very weak practice in terms of the regulations regarding the benefit of the adoption as well as being a recognized right of the person who is not a descendant in this law. As a result of innovations and changes made by the legislator at this point, this institution has been rearranged and improvements have been made in many respects with the aim of observing the "high benefit of adopted small children" in the Turkish Civil Code No. 4721. Now, the descendants can be adopted in such a way that the descendant's interest will not be damaged, and similarly, the adoption is regarded as not harming its interests in relation to the descendant at this point. On the other hand, the adoption of biological parents and the process of its own involvement in this process emerges as a rule determined by law. If it is not possible for the younger person to be unfit, then at this point the court will be appointed as the custodian of consent. On the other hand, the age limit of 35 years old, adopted by the previous law as the age of adoption, has been reduced to 30 years, and married couples have adopted adoption together. In this way, if any of the couples does not have an interest, it is tried to prevent conflicts and problematic situations.
