Abstract (EN)
The change and transformation of the Ottoman Empire from Tanzimat to the Republic is a subject worth analyzing in terms of its context, actors, and consequences. Discussions on the past, present, and future began, and various solutions were sought, in order to eliminate the political, military, and economic weaknesses that emerged in parallel with the loss of power in many areas. The multifaceted searches were also reflected in the field of law, and both the effects of global modernity and local needs arising from centuries of problems prompted the need for innovation and reform. As a result, the approaches and proposals put forward by the Turkists, one of the period's most important intellectual stakeholders, did not ignore fiqh as a source of legitimacy. Turkist intellectuals expressed their views on a variety of issues during the Second Constitutional Monarchy period, including nationalism, religion-state-law relations, progressdevelopment-development, and so on. In this study, which deals with the efforts to reinterpret Islamic law in a socialist identity through concepts such as ictihâd and custom, which provide flexibility and dynamism of interpretation, a holistic evaluation of Turkist views in the field of fiqh has been made from the perspective of the movement's leading names.
