Comparison of international protection status and temporary protection status in Turkey in terms of rights and obligations

As of 2022, Turkey has granted temporary protection status to Syrian citizens, stateless people and refugees from Syria, whose number is more than three and a half million, and has provided rights and defined obligations within the scope of this status. Due to the fact that Syrians ara staying longer than expected, it is a frequently debated issue whether the temporary protection status given to them will be changed in order to provide emergency protection. In case of a change in the status of persons under temporary protection, how their possible new status will lead to changes in their rights and obligations is also another important issue. The statuses that persons with temporary protection status are likely to receive in case of a possible change in status are conditional refugee and subsidiary protection status from international protection status, and refugee status if Turkey removes the geographical limitation imposed on the 1951 Geneva Convention. This work; comparatively examines the rights and obligations of international and temporary protection status holders, and aims to determine how the rights and obligations of temporary protection status holders will change in a possible status change by identifying similarities and differences. Working in this framework; the right to enter the country, the ban on repatriation, the right to reside, shelter and travel, to access health services, the right to education, to work, the right to integration and citizenship, and reside in a certain province, notification, complying with the invitation, paying the service fee in case of unfair use of services, and addresses obligations to comply with the law. If the persons under temporary protection receives one of the international protection status; the procedures and principles to be applied regarding their entry into the country, the right of residence and accommodation, health, education, employment and citizenship rights will change; it determines that there will be no change in the right to prohibit refoulement, and to travel, with the exception of refugee status. In terms of obligations, it concludes that there will be no change in the obligation to notify, to comply with the invitation, pay the service fee in case of unfair use of the services and the obligation to comply with the laws, but there will be a change in the obligation to reside in a certain province.
