Abstract (EN)

In this thesis study, the issues of allocating shelter and settlement areas in forests to disaster victims because of fire, flood, avalanche, landslide and earthquake within the scope of the Additional Article 10 of the Law No. 7269 on "Measures to be Taken and Assistance to be Provided Due to Disasters Affecting Public Life" in the Constitution of the Republic of Turkey, have been examined. The subject of the review is supported by practices conducted in Bingöl, Malatya and Ordu provinces. The obtained data were synthesized, and their positive and negative aspects were evaluated in terms of legal compliance and public contract. Moreover; correspondence between the Emergency and Disaster Management Presidency and the General Directorate of Forestry for the removal of forest areas to outside the forest boundary in order to build housing for disaster victims including examination reports, determination of entitlement, site selection justification report, land determination, appointment of the forest cadastral commission, technical evaluation and report preparation by the commission and finally with the completion of public display period, the registration process of the requested forest area in the name of the Treasury was evaluated. According to the results of the study, the process of allocating forests to build housing for disaster victims is an extremely beneficial service for the public interest in solving the housing problem of disaster victims urgently. Annex Besides; it is estimated that problems such as the lack of uniformity in practice since the Additional Article 10 Implementation Regulation has not been published yet, the lack of a protocol between the General Directorate of Forestry and the Emergency and Disaster Management Presidency in order to reduce the bureaucracy in practice and take quick action, and the registration procedures not being carried out quickly enough by the General Directorate of National Real Estate disrupts the urgency of the process.
