Abstract (EN)

Nuncupative will (oral will), which is a term that regulated under the numbered 4721 Turkish Civil Code, Art. 539-541, is a kind of testemantery desposition that can be only used under the extraordinary situations which prevent the testator from using handwriting and formal forms of will. Testamentary disposition gives the testator the authority to decide future of his/her estate. Giving the chance of having a nuncupative will to the testator, who has no possibility to form a handwriting or formal will because of the extraordinary situations that he/she is under, is the main point of the nuncupative will. By the way, the legislator body's giving the chance to form a nuncupative will to the testator, shows the how respectfull it is to the last requests of him/her.
