Abstract (EN)

The right to live is the most fundamental right. In contrast to this right, other human rights are secondary rights, because the use and existence of other rights depend on the right to live. The problem of right to live of refugee boats cannot be solved only with the immunity of the right to live. Although the number of refugees who died as a result of the increase in the number of refugee boats moving from the North African coast to the Mediterranean with the Arab Spring is not known, it is stated in tens of thousands. The fact that the number of people who died or became lost in the Mediterranean during 2015 alone exceeded three thousand, a pathetic human tragedy on the Mediterranean coast, forcing European leaders to fulfill their humanitarian duties to the refugee crisis. Immigration policies and systems put into practice by the EU have not been sufficient in stopping the refugee boats. Although the European Union creates a reduction in the number of asylum seekers based on its borders with methods such as deterrent policies, barbed wire, pushing back in the seas, not granting asylum application, the fear of re-experiencing the deaths of asylum seekers stresses the EU day by day. The right to live dilemma to be examined with regard to the acceptance or refusal of refugee boats in the Mediterranean to EU coasts will emphasize that the solution to the problem with the facts and interpretation of both situations is that the refugee boats never leave the country of origin or transit.
