Abstract (EN)

The subject of our thesis of Legality in Criminal Law is within the scope of medical intervention. The main theme of the thesis, in the context of criminal law, which conditions are necessary for a lawful intervention? These questions were explained on the basis of issues. In the first part of medical intervention ; concept, historical development, its relations with other branches of law are examined. Medical intervention in the legal systems of different opinions on why not punished by taking medical intervention patients and physicians of the parties rights and obligations of the parties with the concepts are explained. In the second section the necessary conditions for a lawful medical intervention is indicated. In this context, medical intervention by a person authorized by law enforcement, disclosure and consent of the patient, the medical necessity and medical treatment should always be made in accordance with scientific standards that are described in some detail. To behave contrary to the physician's duty of care may be based on caste and appreciated by the physician, the medical standards of the time for the detection of defects is valid, objective and subjective attention will be determined accordingly are explained. In the third chapter in the classic sense of medical interventions to direct therapeutic intent that the only medicine to the advancement of indirect improvements which aim medical interventions, indicating that in this context the property showing the euthanasia, abortion, genetic interventions, castration, sterilization, sex changes, artificial fertilizations, hunger strike, organs and tissues transplant medical experiments are described.
