Abstract (EN)

The purpose of this study is to collect and extract the sayings of Imam Muhammad bin Al-Hassan Al-Shaybani (d. 189/804) scattered in the books of the Hanafi masters narrated by his student Muhammad bin Sama'a (d. 233/847) in what is known as Al-Raqiyat, These are the issues that Al-Shaibani issued a fatwa on during his practice of the judicial profession in the Syrian city of Raqqa, and the scope of the study is determined in the printed books of Hanafi jurisprudence. The importance of this study comes from the author's scientific standing, as he is one of the prominent and diligent scholars of the Hanafi school. The scientific value of the book "Al-Raqiyat" is very famous, along with other books from books that are not apparent from the narrator, as these books contained fatwas in the Hanafi school of thought. Moreover, these narratives received remarkable attention. And the care of the Hanafi jurists who cited it and relied on it. The study followed the historical descriptive approach when translating the two imams al-Shaybani and Ibn Sama'a and introducing their biographies and scientific, and the inductive and analytical approach when counting and collecting the narrations of "Al-Raqiyat" in the available Hanafi jurisprudence books, dropping the repeated ones, and dividing the narrations according to the jurisprudential chapters. These narratives or their differences and weighting between them. Among the most important findings of this study: Ruqyyat are issues spread in the books of the Hanafi masters. The jurists of the Hanafi school of thought transmitted them, confirmed their attribution to the book, and paid special attention to them. Among them are: Al-Natifi, Ibn Maza, Abu Al-Layth Al-Samarqandi, Al-Qadduri, Al-Dahlawi, Al-Sarkhasi, and other jurists. Ruqyahs are among the lost books, but most of their issues are contained in the books of Hanafi jurisprudence, and the topics they dealt with. Keywords: Islamic Fiqh. Al-Raqiyat. Al-Shaibani.
