Abstract (EN)
Construction is the activity of constructing and producing a structure. In order to carry out building production activities, many procedures arising from the legal legislation must be fulfilled. For this reason, it is not possible to carry out construction activities in violation of the legislation and procedures. Mankind has been in building activities for many different purposes, especially the need for shelter, since its existence. Through the ages, many inventions and discoveries have developed the building activity of humanity. With the developing and changing technology in recent years, the construction industry has become one of the largest industries. Occupational accident is known as any event that may result in death of the employee working within the employer while the employer is doing his job, and/or that may render his body integrity mentally or physically disabled. Today, the construction sector, which is considered to be the locomotive sector of the country's economy, is one of the most risky sectors in terms of occupational accidents. In terms of occupational health and safety in the sector, equipment accidents that occur during falling from a height and the use of heavy construction machinery constitute the majority of occupational accidents encountered in various construction productions. Therefore, taking measures regarding occupational health and safety in the construction sector, which has a high probability of encountering the risk of occupational accidents, gains further importance. Both the employer building contractor and the site supervisor have direct responsibility for taking measures related to occupational health and safety. Although the construction site managers are currently performing the job of site management only by signing on paper, those who are in charge of the construction site are responsible for providing all kinds of construction organization, especially occupational health and safety measures, by going to the construction sites every day. If the site manager does not fulfill his obligations within the scope of occupational health and safety, he has some responsibilities in the context of private and public law. These responsibilities are legal responsibilities for the treatment expenses, material and moral compensation of the workers working in the context of private law, and the death pension of those who died as a result of work accidents; In the context of public law, in case of any occupational accident, if the site manager neglects his duty to take occupational health and safety measures, he is faced with a penalty at the rate of fault. The aim of this thesis is to compile and present the most basic information as a guide in order to enlighten and raise awareness of the construction site supervisors who are unaware of the legal and penal responsibilities that may arise from work accidents that may arise at the construction site today.
