Intellectual property rights in terms of Islamic law (Copyright and industrial property rights)

In this study, which deals with intellectual property rights in terms of Islamic law, the approach of Islamic law to copyright and industrial property rights, which constitute intellectual property rights, is examined. Intellectual property rights have become an important issue, especially after the 19th century, with the development of technical, economic and social conditions. Our study consists of an introduction, two chapters and a conclusion, and in the introduction, the subject, purpose and sources of our study are mentioned. In the first chapter, general information about copyrights is mentioned after listing the intellectual property rights and theories related to copyright. After giving information about the industrial property right, the second part was started; here, intellectual property rights are examined in terms of shar'i and financial. By giving comparative information about the nature of the concepts of right, property and property in modern law and Islamic law, the financial aspect of the study has been tried to be revealed. Fiqh evaluation of intellectual property rights was also made; In this context, the views of sects, institutional fatwas and the views of contemporary Islamic law researchers are included. As a result of this study, it has been concluded that intellectual property rights are included in rights and property institutions in Islamic law, have a financial value today and can be subject to legal transactions.
