The violation of private life in the light of European Court of Human Rights and supreme Court Decisions

It is evident that the individual's lifestyle related with social relations have changed day by day as a reflection of the developing technology. Also, as a result of the widespread use of the Internet which is becoming an indispensable part of human life, it is seen that the information about the lives of individuals is exposed not only in face to face but also in the virtual world. However, we live in an age where the state and private or legal persons are more likely to intervene the private life of individuals. As a result of this intense danger, "the concept of privacy" became even more important and needed to be protected, which meant that Article 20 of the 1982 Constitution and Article 8 of the European Convention on Human Rights protected the right to "the concept of privacy" . And the violations of privacy were regulated as a crime in the Turkish Penal Code No. 5237, which entered into force on 01.06.2005. The crime of violating the privacy of the private life which is the subject of our study has been discussed in two parts. In the first part, the concept of private life, its historical development, its place and scope in national and international law are examined within the framework of the opinions expressed in the teaching and the decisions of the European Court of Human Rights. In the second part, the crime of "violating the confidentiality of private life" in Article 134 of Turkish Penal Code numbered 5237 is considered in all aspects in terms of criminal law principles. In this section, a large number of decisions of the Supreme Court have been adopted to give a better understanding the practical application of the subject.
