The situation of private educational institution?s personnel in the aspect of individual Labour Law

Turkish national educational system is consisted of public and private educational institutions to fulfil the general and special purposes defined in the Basic Turkish National Educational Act. It can not be denied the importance of the private educational institutions and its personnel in the Turkish educational system. The subject of this study is these personnel and they are administrators, teachers, specialist educators, master educators and the other personnel. These workers initiate business relations as soon as they start working in a private institution and are accepted as employees. The sides are the employee and the employer in the relations. Employee is the mentioned personnel and the employer is the founder/the representative of the founder and they have business relations. That?s why the legal situation of these personnel is evaluated in the individual labour law in many aspects. These are the initiation of the contract of employment, the rights for the sides, working and resting hours, ending of the contract and its legal consequences. The type of the contract of employment and its way of ending matters for the employees.The obligation to make a contract of minimum a year of time between the employers and administrators, teachers, specialist educators and master educators causes some different point of views and various comments about the right of the employees after ending the contract.In this study the legal situation of private educational institution?s personnel has been identified by examining mainly Act No. 5580 Private Educational Institution, Act No. 4857 Labour Law and related legislation and sources. As a result of researches, the situation of private educational institution?s personnel in the aspect of individual labour law has no clear definitions.
