Behaviors of associations of undertakings in terms of competition law

The purpose of this study is to research the significant roles played by associations of undertakings in terms of Competition Law, and to examine the breaches of competition committed by associations of undertakings through various different decisions and acts of them breaching the competition within the frame of competition practices, and to assess and discuss the subject in the light of various decisions of Competition Board and court judgments in connection therewith. Accordingly, it is aimed to reveal the negative effects made by these breaches in economic life and the points to consider for prevention of breaches of competition law. In this study scrutinizing the legal and economic consequences of behaviors of associations of undertakings breaching the competition, first, undertaking and association of undertakings concepts and types are defined, and then, they are compared to similar other organizations such as associations, foundations, unions and cooperatives in terms of activities and objectives. Also included in the scope of this study are the decisions of associations of undertakings within the context of competition law and the sanctions imposed on the decisions of associations of undertakings breaching the competition. Practices of associations of undertakings breaching the competition and the associated negative effects caused by these breaches are described in details, and the study is supported by various court judgments, decisions of the Competition Board, and various different opinions defended in the doctrine, and the subject matter is examined and described within causal relations and from a wide perspective.
