Abstract (EN)
Arbitration as an alternative dispute resolution system allows parties with corporate law disputes to be resolve in an alternative judicial system. Thus, a dispute arising from corporate law is provided with the opportunity to be tried by an impartial tribunal. In Turkish law, regulations regarding the eligibility of disputes arising from corporate law being resolved in arbitration are inadequate. Hence, neither does the Turkish Commercial Code and other related codes provide a specific nor prohibitive regulation in regard to disputes arising from corporate law being resolved in arbitration. The aim of this thesis is to analyze the availability of disputes resolving in arbitration. After examining the definition, importance and suitability of arbitration in terms of corporate law the view of the doctrine has been discussed.
