Extradition

Extradition is a formal process by which suspects, accused persons and sentenced persons is surrendered by one state to another based on a international convention or rule of reciprocity. All processes related to extradition are carried out in accordance with certain rules and principles. These rules and principles, which must be observed during the extradition process, are arised from the obligations of states defined in the international law. Although it depends on the necessities of the legal system of each state, in generally, conclusion of procedural processes related to extradition may take a long time. In order to solve this problem, simplified extradition procedure is applied where the requested person gives consent to the extradition. In Turkish legal system, the simplified extradition has been regulated in the Law On International Judicial Cooperation In Criminal Matters numbered 6706 under the title of "extradition based on the consent". In this study, first of all, rules and principles extradition will be explained within the frame of the European Convention on Extradition and Law On International Judicial Cooperation In Criminal Matters numbered 6706. In the last chapter of the study, the new institution for the Turkish legal system called "extradition based on the consent" will be mentioned within the frame of the Third Additional Protocol to the European Convention and the Law Numbered 6706.
