Merging of income and monthly in the Turkish Social Security Law

When social security systems are evaluated in a broader perspective, it is seen that these systems are established mainly in order to eliminate some risks threating economic life, which are occurring both in working life and in the general life outside of working life and are served an aim which pursues to guarantee the economic freedom of the people in the future. In this dynamic systems, persons are included into the system based on contributions and it is discussed that these persons obtain a number of income and monthly as a result of paid contributions in case of ensuring some conditions. Each contribution represents different risks in this contribution based system. In case these risks occur in any period of time in the process, it is brought to agenda of merging earned contributions. The social security system in our country is based on the contribution-based on the Law No. 5510. In case of the realization of the risks and the occurrence of conditions, some rights arise in favor of the insured. However, if more than one risk for the insured happens at the same time, will it be considered that a right has been born for each risk and contribution? In such a case, will the social security system not be a means of enrichment? Taking into account these issues, the legislator has issued the merger status of income and monthly with the provisions of Article 54 of Law No. 5510 in detail. I will give wide coverage to judgements in the doctrine as well as focusing that article in my paper. An evaluation will be carried out on the definition of income and monthly in accordance with the systematic of Law, risks defined in law and acquired income and monthly, acquiring conditions of these income and monthly, merging of income and monthly, which will be taken into consideration of those in the case of acquiring an income or monthly in the former law period.
