Abstract (EN)

Some jurists from Ottoman scholars such as Fudayl Chalabi contributed to Hanafi Literature by writing some books peculiar to the subject of the responsibility of the compensation. Shaykh-ul-Islams also continued (traditional) Hanafi jurisprudence in their fatwas related to the responsibility of the compensation. After Hanafis' general responsibility of the compensation had been shown by referring to the works of Ottoman scholars in the first chapter, three subjects related to casual compensation were explained. These three subjects related to causal compensation aim to show how Hanafis left their general responsibility of the compensation. First of them, siaye, is a very important subject that shows the discrepancy of Hanafis from their responsibility of the compensation. Hanafis do not leave their responsibility of the compensation totally in the next two subjects but they put forward different verdicts in some private subjects. In addition, the aim of this study is to show the degree of shaykh-ul-Islams' obedience to Hanafi tradition and their style, the discussed opinions in the madhhab that they preferred by using 17th century shaykh-ul-Islam fatwas on these three subjects.
