An evaluation of preference expressions in Multaqa al-Abhur within the framework of Hanafi intra-sectarian preference method (Buyu' and icare example)

Evaluating the sectarian accumulation and choosing the preferred view within the sect, as the sects complete their formation processes, is a method of passing judgment that fuqaha often resorts to. The words and patterns used during this method, which was put into a certain systematic over time, were termed in the same process and took their place in the sectarian terminology under the name of "alâmâtü'l-fetvâ/sıyağu't-tercih". One of the leading Ottoman scholars, Ibrahim al-Halebî chose the way of using various preferred words, in his work called Multeqa al-Abhur, while highlighting the preferred judgement in the sect. This study, which examines the preferred opinions in the above mentioned work in the context of the suitability of the preference method in the Hanafi school, consists of an introduction, two parts and a conclusion. In the introduction part of the study, the importance, purpose, scope and sources of the research are mentioned. In the first chapter, it is tried to present a general framework regarding the intra-sectarian preference method in Hanafis, who are directly related to the main subject of our study. In this context, firstly, the definition and parts of intra-sectarian preference are mentioned, and then the hierarchy between explicit preference words, a preference method which the author is known to do and preference words are mentioned. In the second part, firstly, the life and works of Halebî and information about Mültekâ, which is the subject of the study, are given. Then, the clear preference words in Mültekâ's book of buyu' and icâre are evaluated in the context of the preference method within the sect. In addition, it has been tried to touch on the preference differences among the works that Halebî used during the writing of Mültekâ and how the preference patterns in these works were used by the author. In the conclusion part, the data obtained as a result of our study are listed and the information about the preference words is presented in tabular form.
