Abstract (EN)
Human curiosity is one of the important factors in inventing many technologies. Although the computer emerged quite late among these inventions, it has left its mark on the last century. Artificial intelligence, a sub-branch of computer science, has become a new realm that has had significant effects especially in the last thirty years and is predicted to continue. The nature of artificial intelligence has led to its discussion not only in the field of engineering, but also in different fields such as philosophy and law. Various discussions have started on the personality of artificial intelligence in law. Although scientific meetings in this field have increased in our country in recent years, these studies abroad have already started and more progress has been made. It is seen that the data of modern law of obligations and Islamic law overlap to a large extent in terms of legal personality and competence. Artificial intelligence will be mentioned more in the coming years, and in the context of Islamic law, it will be necessary to evaluate it both as a commodity and in terms of the possibility of its personality. The positioning of artificial intelligence, especially in terms of legal personality, is more important. In addition, it seems that artificial intelligence can be classified according to different types and degrees, and it will produce parallel results in terms of contracting capacity. In this study, artificial intelligence will be introduced by giving weight to the sources written about artificial intelligence in the field of social science, some related concepts will be included and the contracting capacity of artificial intelligence will be discussed. While doing this, instead of revealing a clear result on behalf of the contracting capacity of artificial intelligence, the data will be evaluated, different opinions will be examined accordingly, and if necessary, a choice will be made among them.
