Temporary protection status in international migration law in the context of human rights

The world is experiencing an extraordinary process of forced migration in the twenty-first century, unlike ever before. Especially with the Arab Spring and the internal conflicts in the Middle East, millions of people have been displaced, primarily seeking refuge in neighboring countries and Europe. This process has brought about numerous human rights violations and legal status debates due to the lack of various legal regulations. Türkiye stands out in this process with the number of refugees it has hosted and the policies it has implemented. Syrians seeking refuge in Türkiye are legally under "Temporary Protection Status." The prolonged duration of temporary protection status brings various uncertainties regarding the provision of social integration and dignified living standards for the protected individuals. Therefore, the continuity of the forced migration phenomenon and the increasing refugee population in various regions of the world highlight the importance of this issue. This thesis evaluates asylum and, specifically, temporary protection status from a legal and ethical perspective within the context of human rights and the international refugee protection regime. The study emphasizes the need for adherence to fundamental human rights principles while implementing temporary protection status and addresses its limits and challenges. In this context, the European Union's attitudes and practices towards refugee groups from different nationalities, such as Syrian and Ukrainian refugees, under temporary protection status have been comparatively examined. The study, using a qualitative research method, utilized document analysis and semi-structured in-depth interviews with key individuals during the data collection process. The obtained data were interpreted within a legal framework. This study emphasizes that temporary protection status is a critical mechanism in the context of human rights and that the international community must make greater efforts within the framework of responsibility sharing and cooperation to protect the fundamental rights and freedoms of protected individuals. The effective implementation of temporary protection policies is considered an important step in ensuring the human rights of the protected individuals.
