Death in labor and social security law

In our legal system, various consequences have been attributed to the death of employees, employers, and the relatives of these persons, who are the parties of the employment relationship. It is possible to find the consequences of death in the employment relationship in various laws. Such as; Turkish Code of Obligations No. 6098, Labor Law No. 4817, Law on the Arrangement of Relations Between Employees and Employers in the Press Profession No. 5953, Maritime Labor Law No. 854, and Social Security and General Health Insurance Law No. 5510. While the direct effect of the death on the labor contract is regulated only in the Turkish Code of Obligations No. 6098; in other laws, some consequences arising from the termination of the contract with the death of employee have included. These are generally provisions concerning periods of leave, severance and death compensation, and the benefits to the rights-holder from the long- and short-term insurance branches. As it is seen, the legal consequences of the death of the parties of the labor contract has regulated scattered in our legislation. Beside the occupational safety legislation and social security legislation, there are new and important provisions in the Turkish Code of Obligations No. 6098 concerning to the subject. The purpose and the topic of this study is to examine the aforementioned provisions as a whole. Also, to specify the effect of the new regulations in Turkish Code of Obligations on labor contract. To this end, firstly, detailed and comprehensive information about the death concept was given. Then, the termination of the contract due to death, due obligation between the parties, the emergence of the restitution of the parties, the compensation to be paid to the rights-holder, in addition to the permits that can be used in case of the death of the relatives of the employee, information on death insurance, occupational accident and death benefits within the occupational disease insurance were provided within the scope of social security legislation.
