Abstract (EN)

The nature of al-amr and matters pertaining to it have existed among the most debated issues in legal theory works, works which examine philosophical and methodological bases of Islamic legal thought since the first periods. It is generally accepted that, in the case of existing significant qarinas, the meaning of al-amr will be, by and large, determined in light of these qarinas. However, adopting a principal manner in respect to the meaning of al-amr al-mutlaq (an amr without any qarinas) was considered as important by legal theorists (usûlîs) and they had detailed discussions within this framework. In this context, it is seen that there is diverse positions within the late classical legal theory literature as well as modern works about certain early Ash'ari and Mu'tezili usûlîs' opinions. At the present time, the critical editions of these early scholars and those who lived in the period soon after them have been published, which provides researchers with an opportunity to do more reliable findings in this subject. That being the case, the debates over the meaning of al-amr in early Ash'ari and Mu'tezili works are dealt within our dissertation and it is attempted to clarify certain usûlîs' view. Furthermore, in light of these discussions, we have made some assessments about certain aspects of legal theory thought.
