Fundamental rights and freedom has a quite old history and its importance for people has been discussed in each historical period. Hammurrabi Period, Ancient Greek and Islam Period are the first periods that fundamental rights and freedom were started to be systematized and recorded. American Revolution and French Revolution are also known to emphasize the importance of fundamental rights and freedom and be the attempts that quarantee constitutional rights in higher levels. The rights like freedom of thought, press freedom, meeting and demonstration rights are considered to be the rights that are needed at all times and are also at the top of agenda with its relation to the politics. In this study, with a broader sense, in the case of the application and restriction of these rights, the process of Constitutional Court application was studied. Some recent cases and the legal processes with which these fundamental rights are to be obtained were evaluated. The press freedom especially in the case of Can Dundar and Erdem Gul, which brought Turkey to the international agenda in terms of fundamental rights and press freedom were especially analyzed in this study.
