Abstract (EN)

International treaties constitute one of the main sources of international law. A treaty gains legality after some proceedings likeformulating, negotiation, signation, ratification and publication. Ratification of international treaties has a crucial role with regard to formation and enforcement of treaties. International treaties bringinto force by the competent authority and become a part of international law. Putting a sign on an international treaty is the most important indicator of intention to comply with international law and to colloborate with international society. The legal aspects of ratification generally regulated with national and international rules. There are problems of practicing of international treaties and some political challenges to ratificate them because of the states' system of separation of powers. This study examines this issues with the comperative perspective of Turkey and Iraq in two chapter. In the first chapter, definition and historical development of international treaties are explained. And then necessity of ratification to gain legality is explained and transactions for the ratification is clarified. As well as conditional ratification and partial ratification are examined. In the second chapter, Turkey's historical process for the ratification of international treaties from the 1923 to 1982 Constitution. Then ratification methods is examined from the establishment Iraq Republic in 1921 to 2005 Iraq Constitution. Finally, smilar and different aspects of Turkish legal system and Iraq legal system is compared with regard to ratification.
