General service contract and worker's payables

Because people have to work in order to meet their needs as a result of their nature, they have tried to solve their livelihood problems. Within the scope of working conditions, contracts have been formed through mutual agreement, both in writing and verbally, and in this direction, the worker and employer relationship has emerged. In today's conditions, a number of contracts have been made due to the fact that working life is quite difficult and because it is not based on solid foundations. Since the worker is the weak party in these contracts, laws or regulations have been tried to be put forward to ensure that the workers are more secured. While employers have been aiming to complete their existing works as soon as possible in line with their own wishes, they have fallen behind in overseeing the rights of the workers who will perform it. Due to this fact, numerous studies have been carried out to defend workers' rights in our country and in the world, and the bias between the worker and the employer has been tried to be reduced to some extent. In our country, it initially can be said that the bias between the employer and the worker has been partially resolved with the Turkish Code of Obligations No. 818 adopted from the Swiss Code of Obligations, and then the Turkish Code of Obligations No. 6098, the Labor Law No. 4857, and other relevant laws. Employment contracts or service contracts have been arranged between the employer and the worker as per the work done. With these contracts, the employer gives the worker the job he/she has to do, and the worker is entitled to work as dependent on his employer for the given job and to be paid in return. In this direction and within the scope of our work, initially, the General Service Contract and the Worker's Payables will be discussed. Its relations and applications with the Code of Obligations No. 818, the Turkish Code of Obligations No. 6098, the Labor Law No. 4857 and other relevant laws will be evaluated.
