Abstract (EN)
The subject of this thesis is unfair competition crimes. Unfair competition crimes are regulated not in the Turkish Criminal Code, but in the art.62 of the Turkish Commercial Code. In addition, unfair competition is regulated in the Codice Civile by Italian legislator. However, according to Italian law, criminal liability arises only if the unfair competition acts include violence or threat.(Italian Penal Code art.513 bis) Since this thesis was prepared at the Foggia University(Italy) and academic studies on unfair competition are generally published in comparison with Swiss law, legislations and judgments in Italian law are also included in order to contribute to the literature. In Turkish law, unfair competition crimes are among the crimes subject to complaint. Unfair competition crimes are only committed wilfully. Lastly, as sanction, while both prison sentence and fine are envisaged for real persons, security measures are imposed on legal entities.
