The responsibility to protect: The case of Syria and Libya

Human rights violations occur across the globe, whether caused by racial injustice, gender inequality, poverty, genocide, or even war crimes. The effort to protect human rights extends the term just war to humanitarian intervention, in the 20th century, with the concept of Responsibility to Protect. The Arab Spring, which started in Tunisia, spread to many countries over time. In Syria and Libya, anti-government movements and uprisings turned into a civil war. While there was a humanitarian intervention in Libya, that's not the case for Syria. In the thesis, these two crises will be briefly explained and the Responsibility to Protect and its implementation will be evaluated with these two different decisions. In the thesis, documents published by the United Nations were used both while explaining the development of Responsibility to Protect and examining case studies. In cases where human rights violations occur, whether or not to intervene, and in what situations to intervene, is an ongoing debate. In international relations theories, The English School is one of the theories that discussed humanitarian intervention thoroughly. The humanitarian intervention debate in English School is between pluralists who argue that there should be no intervention in order not to disrupt the international order and solidarists who argue that intervention should be made to ensure justice, in cases where human rights are violated. English School writers argue that today's international society has a pluralist structure, however, over time it has become solidarist. Accepting English School's assumption that the international society is solidarist, in the thesis, can the concept of the Responsibility to Protect be considered as a solidarist institution of the international society? Focused on the question. While evaluating the responsibility to protect as a primary institution, used the methods of identifying primary institutions of Buzan and Holsti, who are the pioneers of both the theory and the concept of primary institutions, and used the founding texts of the Responsibility to Protect.

Project management: Investigation on causes of delay in construction projects in Benghazi Municipility-Libya

Benghazi Municipality has a problem in finishing the construction projects in due time which has a negative impact on the success of these projects such as, exceeding the time limit, increasing the cost estimates. These negative effects reflect themselves on the different spheres of life and the whole society in general. It is important to investigate this phenomenon in the period between 2013-2017 through studying the causes behind it. This research aimed to investigate the main causes of delay in the completion of construction projects in Benghazi Municipality in Libya, and to identify the average of time overrun. It also analyzed and ranked the most important causes of delay according to their FI, SI and the importance index II from the point of view of contractors and consultants. The method used for the analysis was mixed method research design (quantitative & qualitative) as a research approach for this research, while the interview tool and case study were selected to collect qualitative data and a questionnaire tool has been designed to collect the quantitative data. The field survey of a questionnaire contained 69 possible causes for the delay categorized into four major groups. The questionnaire was distributed to the sample of the study that included 54 participants, which is at the same time the population. The population included 36 contractors and 18 consultants which represents two main parties in construction projects, and the interview tool was selected to study one case with a project exposed to time and cost overrun. The research showed delay in many construction projects conducted for BM during the period between 2013-2017, where there was a delay in 54 projects out of 104, and this represent 51.9% of the projects. Moreover, the study indicated that the average of time overrun is between (10% and 30%) of the original time of the projects. The study also showed that 41.7% of the respondents believe that the main reason of the delay is the contractor. However, the results concluded that the following are the top five delay causes arranged according to the II: • The delay in paying the financial dues to contractors by the client. • Award project to lowest bid price (the contractor who has the lowest bid). • The delay in due payments to the suppliers by contractor. • Difficulties in financing the project by the contractor. • Dispute with neighbors. Keywords: Frequency Index (FI), Severity Index (SI), Importance Index (II), Benghazi Municipality (BM), causes of delay, construction projects, Libya

Koruma sorumluluğu ilkesinin ekonomi politiği

Uluslararası güç ilişkileri çerçevesinde uluslararası hukuk da şekillenmektedir. Bu şekillenme sonucunda yeni hukuki söylemler ortaya çıkmıştır. Bu sebeple uluslararası güç ilişkilerinin bizzat açıklayanı uluslararası hukuk değildir. Uluslararası güç ilişkilerinin 2000 sonrası uygulamasında kullanılan hukuki söylemler insani müdahalenin koruma sorumluluğuna dönüşmesine sebebiyet vermiştir. Geçmişte devletlerin iç işlerinde sınırsız egemenlik sahibi olduğu görüşü terk edilmiş, yerine uluslararası sisteme uyum sağlayamayan devletlerin yaşadığı iç problemlerin giderilmesi söylemiyle koruma sorumluluğu adı verilen uluslararası müdahale yöntemi ortaya çıkmıştır. Uluslararası hukuk ve koruma sorumluluğunun ekonomi politiği tez içerisinde incelenecektir.

NATO intervention in the libyan crisis and the implementation of the responsibility to protect

The events that occurred during the Arab Spring in early 2011 triggered the world community. Violent socio-political processes and changes in the ruling regimes of the Middle East and North African countries, particularly in Libya, led to the emergence of a political and moral dilemma for the Western World. In this context, this thesis examines the importance and influence of the North Atlantic Treaty Organization's (NATO) intervention and response regarding this issue, as well as the questions of the motives behind the military operation in Libya. To this end, the thesis specifically discusses the positions of some key NATO members, namely USA, France, UK, Germany, as well as Italy, regarding the intervention in Libya based on the principle of 'Responsibility to Protect' under the United Nations Security Council (UNSC) authorization of Resolution 1973.

Into the wild: Ottoman photographic excursions to Libya at the turn of the twentieth century

This study investigates the Ottoman center's conceptions and representations of the periphery, at the turn of the twentieth century as reflected in the representation of Libyan provinces of the empire. The main sources used in this study are the illustrated travelogues of two Ottoman officers posted to Libyan provinces. The first of these is Azmzâde Sadık El-Müeyyed's travelogue, published in 1896 and entitled "Travel in the Great Desert of Sahara," , about his travels in 1895. The second is Cami Baykurt's, "From Tripoli to the Great Desert of Sahara", which was published in 1910 and detailed his travels in 1906-1907. The theoretical framework of the study is orientalism and the Ottoman Empire's appropriation of orientalist discourse and practices. In its effort to be rigorously historical and contextual this study is based on a number of comparisons. Starting with comparing European colonial policies, concepts with Ottoman Empire's colonialist inspired policies and concepts adopted by the state in Libyan provinces and in the light of these comparisons the Ottoman officers' representations are compared with European orientalist discourse and representational conventions. The authors' renditions of Libya were related to the social and political context of the Libyan provinces in particular and the Ottoman Empire in general, thus their accounts give insights about these. The representations of the authors are also compared with each other, for their conceptions and representations do not monolithically reinforce the official imperial view, but also complicate it. The main argument of this study is that the representation of the Libyan provinces by these authors was inscribed in the orientalist discourse. Rather than challenging and opposing European orientalist constructs, the Ottoman authors ideological constructs about Libyan and peripheral subjects of the provinces were much more parallel to the former. However this does not mean that the Ottoman actors' representations were mere copies of European constructs. The Ottomans used the discursive and visual frameworks of orientalist representation, which was effective in the establishment of European colonial hegemony over the Orient, for their own purposes and agendas. In this way the Ottomans representations constitute an example of the complex process of the appropriation and multiplication of the orientalism in different contexts. The methodological discussions about the usefulness of photographs in further fracturing and complicating the eurocentric discourse of orientalism is central to the study.

After cold war era NATO alliance's military interventions; Comparative probe of Bosnia-Kosovo-Afghanistan-Libya cases

This thesis aims to prove that since the changing security conditions and the new role of the alliance, NATO treaty is subject to be reviewed. The methodology is, to analyze the theory of military intervention through the case study of the Post-Cold War NATO interventions in Bosnia 1995, in Kosovo 1999, in Afghanistan 2001 and in Libya 2010. Key research questions include: As far as post-Cold War conditions concerned, to what extent can military force be an appropriate and effective instrument for solving or averting crises and ensuring respect for sovereignty rights? Are the issued NATO concepts, as some critics argue, too easily abused by powerful states seeking to justify wars fought for self-interested reasons? When we look at the various NATO strategic concepts, whether security conditions changed or not? If yes, how NATO treaty still serves for new challenges? Is there any possibility to revise NATO treaty and how? The thesis will assess the arguments of both proponents and opponents of the concept of international military interventions. The cases were chosen as recent interventions that have often been cited as a good example of variously aimed coalition campaigns, and one which most proponents of the concept supported, at least in principle.

Impact of training on the performance of employees in Libyan oil companies

The need for improved productivity has become universally accepted and that it depends on efficient and effective training. Staff training and development are based on the premise that staff skills need to be improved for organizations to grow. This study examines to what extent the training impacts on the performance and skills of employees in Libyan oil companies, and what are the significant training related factors influencing job performance. A questionnaire based on in-service training scale (Bartlett, 2001, Bulut & Çulha, 2010) adopted to Arabic/Libyan context, is implemented at four Libyan oil companies with the highest number of employees, on a sample of 150 participants. Collected data is analyzed. Multiple linear regression analysis supports the hypothesis that training related variables have positive impact on employees' job performance. The results indicate that there is a statistically significant effect of training on the employee performance in the oil companies, where the three sub dimensions Training motivation, Personal-related benefits of training and Support from Colleagues among the seven dimensions of the in-service training scale has the highest effect on employee performance in oil companies. Therefore, both private and public sector organizations, need to understand the importance of training of employees as a critical role for the HR function to provide job performance and productivity improvement.

The formation of construction contracts in Turkey and Libya and a comparison of the rights and liabilities of the parties

This thesis is an attempt to examine the conditions of the construction contracts in the Libyan and Turkish law so as to reveal the weaknesses in the formulation of the Libyan law contracts according to the Turkish law, such as FIDIC contract models to reduce conflicts and disputes, and to benefit from the Turkish experience in the construction industry. This is in light of the fact that there is an imbalance in the obligations of the parties in terms of contracts as regards force majeure conditions and the arbitration clause, in addition to the Allocate of risks cause behind the problems of construction projects in Libya nowadays, which should be corrected and reformulated in line with the development of international contracts. Advocacy of human rights' international demands in criminal justice field and institutional complexity in Libya

This thesis addresses how human rights advocacies act to promote human rights logic in Libya and the extent to which their actions become influential on Libya Criminal Court decisions by time. It, also, seeks to investigate how institutional complexity that arises from adoption of international demands is resolved interactively in a criminal court. First, I draw attention to the literature related to adoption of international demands from a global field level to local organizational level, multiplicity of institutional logics and institutional complexity. Then, I address some empirical information about the justice field in Libya aiming to explain how legal developments led to Criminal Punishment Logic being the default logic in the justice field as against advocacy of international demands that lead to Human Rights Logic being second in order. Details of a qualitative and quantitative methodologies, based on the use of longitudinal analysis of case studies, are given. Results reveal that; first, international organizations facilitate adoption of international demands in the criminal justice field through an advocacy mechanism of human rights. Second, adoption of international demands in the criminal justice field generates institutional complexity that results in inconsistencies between institutional logics. Third, actors at organizational level use legal reasoning to promote their institutional logics. Hierarchal referral, built-in frameworks, informal agreements, and experts' reports are mechanisms of resolving inconsistencies between institutional logics. Discussion and suggestions for future research are attended to at the end of the thesis.

Libya tarihinde kabilecilik (1911-2011)

Money supply, inflation and economic growth in Libya

The aim of this study is to exam the relationship between money supply, inflation and economic growth in Libya. Vector Auto-regression Model, Johansen co-integration test and Granger causality were used in the analysis for the sample period 1960-2016. The results shown that all the variables are co-integrated in long term. Furthermore, the increase in economic growth by 1% decreases Inflation by 1.55%. While the growth in money supply by 1 percent will increase the price level by 1.15 %. According to the results of causality test, there is no causality direction in short run between the study variables except unidirectional causality among economic growth and money supply running from RGDP to RM2 according to 5% significance level. In addition, the response of inflation on the economic growth is negative all throughout the ten periods, also the same applies to money supply and economic growth. Also besides, economic growth had an early and positive impact on money supply.

EU's foreign policy towards the Southern Mediterranean region: The case of Libya

This thesis analyzes the Europeanization of the European Union's foreign policy towards the Southern Mediterranean region, adopting a bottom-up Europeanization approach which stresses the impact and role of member states on the EU's foreign and security policy and the uploading process of national foreign policy preferences driven by national interests to the EU level. On this basis, the thesis examines the degree of the Europeanization of European foreign policy towards the Southern Mediterranean region in the light of the case of Libya in the post-Lisbon era. The thesis consists of three chapters. The first chapter presents an overview of "Europeanization" as a conceptual and theoretical framework, focusing on different conceptualizations, perspectives, dimensions, and scopes of Europeanization and explains the Europeanization perspective adopted in this study. The second chapter focuses on the political integration of Europe and the EU foreign policy developments and discusses the process of Europeanization in the foreign policy area. It also examines the key dimensions of the EU's engagement with the Southern Mediterranean region, explaining the main initiatives and their consequences. In the third chapter, the thesis analyzes the case of Libya, focusing on the EU policies and responses in the aftermath of the Arab Spring. In conclusion, in the light of the Libya case, the thesis presents how "bottom-up Europeanization" gained ground in the EU foreign policy towards the Southern Mediterranean region and discuss the degrees, limits and prospects of the Europeanization of EU foreign policy.
