Child sexual abuse as a right violation a sociological investigation on the case of Diyarbakır

Children are the future of a society and their upbringing, education, and having a healthy personality are important for them to adapt the societal life. Moreover, children's rights have been the subject of defined or acknowledged regulations of international and national judiciary. As it is at the top of the agenda in most underdeveloped or developing countries, children's rights violation also has its place in Turkey. Along with the country's position, Diyarbakir is a common place for child rights violation. Most of the violations are not brought to the attention of public. Because children live under their parents' watch, the violations they have within the family is considered to be in the boundaries of "private space". This paper is significant in addressing the subject from social science perspective. In connection with the importance of the subject, this paper deals with how a sociological perspective would be and how this perspective would affect the practice. The purpose of this research is to analyse the documents for child sexual abuse in Diyarbakir with the help of district court decisions. This research first covers child and childhood in a theoretical framework, later includes international and national child rights laws and agreements. Children's sexual immunity rights has been covered in accordance with the international and national laws. Finally, the documents for justified district court decision related to child sexual abuse have been analysed in order to determine the other right abuses of along with sexual immunity right.
